1. Introduction and Acceptance

Welcome to HomeSuit. These Terms of Service („Terms“) govern your use of the website behomesuit.com (the „Site“) and any purchase of products from VELOCITYGLOBE CO LLC („Company“, „we“, „us“, „our“), operator of the HomeSuit brand. By accessing or using our Site, or by placing an order, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not use the Site or purchase our products.

These Terms apply to all users, including visitors, customers, and anyone else who accesses the Site. We sell family loungewear, pajamas, and home clothing. All transactions are processed in Euros (EUR). We primarily serve customers in Europe but accept orders worldwide, subject to shipping restrictions set forth in our Shipping Policy.

2. Eligibility

To place an order or create an account on our Site, you must be at least 18 years old or the age of majority in your country of residence. By using the Site, you represent that you meet this age requirement. If you are under 18, you may only use the Site with the involvement of a parent or guardian.

3. Account Registration and Security

You may browse our Site without creating an account. However, to place an order, you may choose to register an account or checkout as a guest. If you create an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately at popular@behomesuit.com of any unauthorized use of your account. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

4. Product Information and Pricing

4.1 Product Descriptions
We strive to display accurate product descriptions, colors, sizes, and images. However, we do not warrant that product descriptions, colors (due to monitor variations), or other content on the Site are complete, reliable, current, or error-free. If a product offered by us is not as described, your sole remedy is to return it in accordance with our Return Policy.

4.2 Pricing
All prices are listed in Euros (EUR) and include applicable value-added tax (VAT) for orders shipped within the European Union, unless otherwise stated. For orders shipped outside the EU, prices are exclusive of VAT, and you may be subject to import duties, taxes, and customs fees as described in our Shipping Policy. We reserve the right to change prices at any time without prior notice. However, price changes will not affect orders that have already been accepted by us.

4.3 Typographical Errors
In the event a product is listed at an incorrect price or with incorrect information due to a typographical error or system error, we reserve the right to refuse, cancel, or limit any orders placed for that product, even after an order confirmation has been sent. If your order is canceled after payment has been processed, we will issue a full refund.

5. Orders and Acceptance

5.1 Placing an Order
When you place an order through our Site, you are making an offer to purchase the products in your shopping cart. After you submit your order, you will receive an email acknowledging receipt of your order („Order Acknowledgment“). This does not constitute acceptance of your order.

5.2 Order Acceptance
We reserve the right to accept or reject your order for any reason, including product availability, payment verification, suspected fraud, or shipping restrictions. Our acceptance of your order occurs when we send you a shipping confirmation email. At that point, a binding contract is formed between you and VELOCITYGLOBE CO LLC for the products listed in the shipping confirmation. Any products not included in the shipping confirmation are not part of the contract.

5.3 Order Cancellation by Us
We may cancel any order before shipment if:

  • The product is out of stock.

  • Your payment method is declined or cannot be verified.

  • We detect unusual or potentially fraudulent activity.

  • The shipping address is in a restricted region (see Shipping Policy).

  • A pricing error occurred as described in Section 4.3.

In such cases, we will notify you and refund any amounts paid.

6. Payment Terms

All payments must be made in Euros (EUR). We accept the following payment methods:

  • Credit cards: Visa, Mastercard, American Express, Discover

  • Debit cards bearing the Visa or Mastercard logo

  • PayPal

  • Apple Pay

  • Google Pay

  • Shop Pay

Payment is due at the time of checkout. By providing a payment method, you represent that you are authorized to use that payment method. We use third-party payment processors (Stripe, PayPal, and others) to handle payment transactions. We do not store full credit card details on our servers. Your payment information is encrypted and processed in compliance with PCI DSS standards. If your payment fails, your order will not be processed.

7. Shipping and Delivery

All shipments are subject to our Shipping Policy, which is incorporated into these Terms by reference. Delivery dates are estimates only. We are not liable for delays caused by carriers, customs clearance, or other events beyond our reasonable control. Title and risk of loss for products pass to you upon delivery to the carrier. For EU customers, risk passes when you (or a third party designated by you, other than the carrier) take physical possession of the goods.

8. Returns, Refunds, and Warranty

Returns and refunds are governed by our Return Policy, which is incorporated into these Terms by reference. We provide a 30-day return period for most products (excluding final sale items). For EU customers, your statutory right of withdrawal under Directive 2011/83/EU is described in the Return Policy. Products are sold as-is, with no express warranties other than those required by applicable law. For defective products, your remedies are as set forth in the Return Policy.

9. Intellectual Property Rights

All content on our Site, including text, graphics, logos, images, product designs, software, and the compilation thereof, is the property of VELOCITYGLOBE CO LLC or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. The HomeSuit name and logo are trademarks of VELOCITYGLOBE CO LLC. You may not reproduce, distribute, modify, display, perform, or transmit any content from our Site without our prior written consent, except for personal, non-commercial use.

10. Prohibited Activities

When using our Site, you agree not to:

  • Violate any applicable law or regulation.

  • Infringe upon the intellectual property rights of HomeSuit or any third party.

  • Use the Site to transmit harmful code, viruses, or malware.

  • Interfere with the security or functionality of the Site.

  • Attempt to gain unauthorized access to any portion of the Site or any other user‘s account.

  • Use robots, crawlers, or similar data mining tools except as permitted by our robots.txt file.

  • Engage in any activity that imposes an unreasonable load on our infrastructure.

  • Post false, misleading, or fraudulent information.

  • Harass, abuse, or harm any person.

We reserve the right to terminate your access to the Site for violating any of these prohibitions.

11. User-Generated Content

If you submit product reviews, testimonials, photographs, or other content to our Site („User Content“), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use, reproduce, modify, adapt, publish, and display such User Content in connection with our business. You represent that you own or have the necessary permissions to grant this license, and that your User Content does not violate any third-party rights or applicable laws.

12. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR SITE AND ALL PRODUCTS ARE PROVIDED ON AN „AS IS“ AND „AS AVAILABLE“ BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

SOME JURISDICTIONS (INCLUDING CERTAIN EU MEMBER STATES) DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON CERTAIN CONSUMER RIGHTS. IN SUCH JURISDICTIONS, THESE DISCLAIMERS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS AFFECTS YOUR STATUTORY RIGHTS AS A CONSUMER.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VELOCITYGLOBE CO LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR THE PURCHASE OF PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR PURCHASE OF PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

For customers in the European Union, these limitations do not apply to liability for death or personal injury caused by our negligence, fraud, or willful misconduct, or for any other liability that cannot be limited by applicable consumer protection laws.

14. Indemnification

You agree to indemnify, defend, and hold harmless VELOCITYGLOBE CO LLC and its officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys‘ fees) arising out of or related to your violation of these Terms, your misuse of the Site, or your violation of any law or third-party rights.

15. Governing Law and Dispute Resolution

15.1 Governing Law
Except as otherwise required by mandatory consumer protection laws in your country of residence, these Terms and any dispute arising out of or relating to these Terms or your purchase of products shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of laws principles.

15.2 Dispute Resolution for EU Customers
If you are a consumer residing in the European Union, you may bring any dispute arising from these Terms before the courts of your country of residence. Additionally, the European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/. We are not obligated to participate in ODR but we will endeavor to resolve disputes amicably. Please contact us at popular@behomesuit.com before initiating any legal proceedings.

15.3 Mandatory Arbitration for Non-EU Customers
For customers outside the European Union, any dispute arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in Jefferson County, Kentucky, in accordance with its Consumer Arbitration Rules. Class actions and class arbitrations are not permitted. You agree to waive the right to a trial by jury and the right to participate in a class action.

16. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, pandemics, strikes, labor disputes, supply chain disruptions, cyberattacks, or changes in law.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision, nor shall it prevent future enforcement.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and VELOCITYGLOBE CO LLC regarding your use of the Site and purchase of products, superseding any prior agreements or communications.

20. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. The revised Terms will be posted on this page with an updated „Last Updated“ date. Changes are effective immediately upon posting. Your continued use of the Site after any changes constitutes your acceptance of the new Terms. For material changes, we will notify you by email (if you have an account) or through a notice on the Site.
